A class-action lawsuit against the legal standing of a land-issued mask mandate and mandatory COVID-19 vaccinations or voluntary testing for educators was filed by 88 teachers and other schoolhouse district employees, including five from Springfield School Commune 186, in Sangamon Canton Circuit Courtroom Monday afternoon.

Included in the lawsuit were teachers from Due north Mac and Staunton school districts.

The lawsuit seeks emergency injunctive relief from executive orders issued by Gov. JB Pritzker requiring masks in Illinois schools for teachers, students, staff and visitors and requiring mandatory vaccinations or testing for school personnel.

No hearing on the lawsuit has been scheduled nonetheless.

Twenty-one school districts, including Commune 186, were named as defendants forth with Pritzker, Illinois Department of Public Health manager Dr. Ngozi Ezike and Illinois State Board of Didactics superintendent Carmen I. Ayala.

Plaintiffs in the lawsuit from Springfield include Kimberly Smoot, a family and consumer science instructor at Springfield High School; Ryan Jugan, a 4th- and fifth-grade math teacher at Sandburg Simple School; Kadence Koen, a math and business organization teacher at Southeast High Schoolhouse; Erica Thompson, an English linguistic communication arts and Gorging (Advancement Via Individual Determination) teacher/coordinator and Kevin Shaw, an HVAC&R service journeyman with the district.

Shaw, who contacted The Country Journal-Register, said he was originally part of the lawsuit but sought to take his proper noun removed when it was clear that the plaintiffs were but going to be teachers.

The lawsuit was filed past Thomas Thou. DeVore, Jeffrey A. Mollet and Erik D. Hyam and the Silver Lake Group, Ltd., from Greenville. DeVore has filed lawsuits around the land related to the governor'south executive orders issued during the COVID-nineteen pandemic.

Koen was on unpaid leave from the commune from Sept. 21 to November. 17 because she refused to disclose if she was vaccinated or submit to testing. Koen, who cited the Illinois Wellness Care Right of Conscience Human action, later submitted her vaccination card and returned to teaching at Southeast on Nov. 19.

Another teacher from the district, Kingsley Keys of Franklin Heart School, refused to get along with either the vaccination or testing and was terminated in a vote by district board of education.

"We're not suing for any money, just suing for the injunction, so I experience similar that doesn't exactly seize with teeth the hand that'southward feeding anyone," Koen said in response to how some people might view her office in the lawsuit.

"We have state police that says you lot tin't compel somebody to be vaccinated or tested to try to prevent the spread of an communicable diseases. They can refuse to do so and if they refuse, the simply remedy for the Department of Wellness is to quarantine the person while they're a public health gamble," said DeVore, reached Tuesday.

School districts "trying to do the bidding of the governor" tin can't threaten people'south livelihoods considering they don't want to vaccinate or test, DeVore added.

"The coercion and the manipulation that'south being placed on these people is sickening," he said.

A spokeswoman for District 186 didn't reply to a asking for comment.

The newspaper didn't immediately hear back from a spokeswoman for Pritzker's office.

Also named in the lawsuit were Matthew Allen, who teaches psychology, sociology, American Government/Civics and world history at North Mac High School in Virden and Nicole Potthast, a science teacher at Staunton Junior High School.

Amongst other lawsuits DeVore has filed is an Oct. xx class activity lawsuit on behalf of parents taking aim at mask requirements and exclusion of students from schools. Among the other surface area school districts named in the lawsuit were Ball-Chatham, Carrollton, Mount Pulaski, Petersburg PORTA, Jacksonville, North Mac, Carlinville and Staunton.

That matter is set for a status hearing before 7th Circuit Approximate Raylene Grischow at 11 a.m. Thursday.
